Article I. Name

The name of this organization shall be the Huntsville Education Association, Inc., hereinafter referred to as the “Association”.

Article II. Purpose

  1. To work for the welfare of the school children, the advancement of education, and the improvement of educational opportunities for all
  2. To represent its members in relations with their employer
  3. To develop and promote the professional interests and concerns of the members
  4. To promote professional attitudes and ethical conduct among education employees
  5. To enable members to speak through the Association with a collective voice on matters pertaining to education and to present their individual and common interests before the school board, the community and appropriate legal authorities
  6. To hold property and funds for the attainment of Association purposes
  7. To actively participate in the district, state, and national programs of the united education profession (amended 1/7/16).
  8. To protect the constitutional and legal rights of the members of the Association

Article III. Affiliation

Section 1. This Association is a local affiliate of the Alabama Education Association and the National Education Association. As such, it shall obligate itself to the payment of dues, sending delegates, and such other responsibilities as may be imposed by the parent organization.

Section 2. The Association shall not affiliate with the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO) (amended 1/7/16). or any other labor organization.

Article IV. Membership

Section 1. Association membership shall be unified with the Alabama Education and the National Education Association.

Section 2. Membership shall be open to all employees of the Huntsville Board of Education, including teachers, administrators, supervisors, and support personnel.

Section 3. The Association shall not deny membership to individuals on the basis of race, color, national origin, creed/religion, gender, sexual orientation, age, handicap, marital status or economic status, nor shall any organization which so denies membership be affiliated with the Association. Section 4. Members shall adhere to the Code of Ethics of the Education Profession and shall support the stated purposes and objectives of the Association.

Section 5. No member shall be censured, suspended, or expelled without due process before the Board of Directors with a right to appeal to the Representative Assembly. (amended 1/7/16).

Article V. Officers. Board of Directors. And Representative Assembly

Section 1. The Association shall apply the one-person-one-vote principle for representation on all its governing bodies except that the Association shall provide for ethnic-minority representation at least proportionate to its ethnic-minority membership. Further, the Association shall provide for proportionate representation between its supervisory and non-supervisory members and proportionate representation between its certified (Active) and classified (Support) members.

Section 2. The officers shall consist of the following: President, Vice-President, Immediate Past President, Secretary and Treasurer. (amended 1/7/16).

Section 3. The Board of Directors of the Association shall consist of the following:

a. Officers of the Association
b. Directors elected from the membership at a ratio of 1:100 members, or major fraction thereof

Section 4. The Representative Assembly shall be the legislative body of the Association and shall consist of the following:

a. Members of the Board of Directors
b. Association Representatives from each building at the ratio of 1:10 members, or major fraction thereof, in no case less than one per building.
c. Chairpersons of Association committees may serve as ex-officio members of the Representative Assembly with no authority to make motions or vote.

Article VI. Amendments

Amendments to this Constitution shall be adopted at a regular meeting of the Representative Assembly by a two-thirds vote of the members present and voting, provided that the proposed amendment(s) was read at a previous Representative Assembly meeting and copies distributed to all members at least 20 days prior to the date of consideration for adoption, which may be accomplished through publication of the association newsletter.
